Business registration justifies the immediate termination of your own apartment by the landlord.

A good business idea, the necessary starting capital, a lot of motivation ?! Then the business registration is actually nothing in the way ... right?

BUT, because just going to the business registration office - or rather the registration of your own business made there - can (as the following case shows) result in the landlord terminating your own apartment without notice!

In such a case, the Federal Court of Justice has in its decision of the 31. July 2013 (http://juris.bundesgerichtshof.de/cgi-bin/rechtsprechung/document.py?Gericht=bgh&Art=en&nr=64986&pos=0&anz=1) and clarify the facts very clearly and unequivocally:

The registration of a trade in their own apartment is namely a unilateral contract amendment of the private lease, which allows the landlord to issue the termination without notice.

But of course the danger does not only apply to start-ups, but - as the present case shows - also to all existing entrepreneurs, businesses and even freelancers. If you have already registered your business or a freelance activity in your own rented apartment today, you run the risk in this constellation that the landlord "makes use of his rights" and unexpectedly pulls this ace up his sleeve today, tomorrow or at some point - especially if the relationship is already tense, for whatever reason.

And even if you start small, don't bother anyone or plan everything neatly and fulfill your duties as an entrepreneur in all respects - the company remains a ticking time bomb within your own four walls.

What can you do about it?

One possibility is obvious: Seek the clarifying conversation with the landlord and hope that he agrees. You should insist on a written confirmation. But please be aware of what happens when he says "no".

The other option is actually just as obvious. Namely consistently separate private and business from each other and outsource the industry. Optionally in a specially rented office or in a business center.

Which of the two options (own office vs. business center) is the right choice, of course, depends heavily on the individual conditions and requirements and can be due to the complexity in the fewest cases to answer flat-rate.
